Abstract
The implementation of informed consent plays a crucial role in ensuring legal protection for doctors and patients in surgical procedures. This study aims to analyze the implementation of informed consent at a surgical specialty hospital in East Java, focusing on legal protection for surgeons. This research employs a juridical-empirical method, combining a statutory approach with semi-structured interviews involving doctors, patients, and other healthcare professionals. The findings reveal that although informed consent has been implemented, several challenges persist, including patients' limited understanding of the information provided and doctors' time constraints in explaining medical procedures comprehensively. Additionally, there are instances of delegation of informed consent procedures to non-physician medical staff, which could potentially lead to legal disputes. The study concludes that legal protection for doctors can be enhanced through the proper implementation of informed consent in accordance with applicable laws, including providing patients with complete and clear information. It is recommended that the hospital provide additional training for medical personnel regarding the implementation of informed consent and optimize communication systems between doctors and patients. This effort is expected to minimize the risk of legal disputes and improve the quality of healthcare services.
