TUGAS AKHIR PENERAPAN MEDIASI PENAL SEBAGAI UPAYA UNTUK MENYELESAIKAN KASUS KEKERASAN DALAM RUMAH TANGGA (Studi Unit Perlindungan Perempuan dan Anak Satreskrim Polres Malang)

Domestic violence is a serious problem and can occur in many parts of the world and has been a long-standing issue. Domestic violence includes various forms of violence such as physical violence, psychological violence, sexual violence, and neglect. The Protection of Women and Children Unit of the Malang Police Criminal Investigation Unit has implemented a penal mediation approach for domestic violence cases as a path of peace (restorative justice) as regulated in Police Regulation No. 8 of 2021 concerning Handling Criminal Acts Based on Restorative Justice. The research aims to find out the application and obstacles to the application of penal mediation to resolve domestic violence cases in the Protection of Women and Children Unit of Satreskrim Polres Malang by using empirical juridical methods with a qualitative approach, collecting data through interviews and observations at the research location as well as analyzing laws and regulations and legal literature. In its application, it shows that penal mediation can be an effective alternative solution, prioritizing reconciliation between the perpetrator and victim, and considering the interests of the family. However, there are still obstacles that occur such as lack of legal regulations, inadequate legal institutions, and lack of participation from the community.
