Analisis Yuridis Pembagian Harta Waris Bagi Ahli Waris Yang Berganti Jenis Kelamin Berdasarkan Kompilasi Hukum Islam (KHI)

Many cases of gender reassignment in Indonesia have caused difficulties when someone becomes an heir because there are no regulations regarding heirs who change gender and have legal implications for inheritance distribution issues. The purpose of this study is to analyze the distribution of inheritance for heirs who change gender and analyze the legal implications of the distribution of inheritance for heirs who change gender. The method used in this writing is normative legal research. The results of this study are that the distribution of inheritance to heirs who change gender is entitled to a portion of the inheritance because in the Compilation of Islamic Law, changing gender is not included in the inheritance barrier, in the Compilation of Islamic Law there are no regulations that explain the distribution of inheritance for heirs who change gender and have legal implications for the distribution of inheritance who change gender from the family and social aspects as well as the judicial environment. The author's recommendation, changes should be made by adding concrete regulations in the Compilation of Islamic Law regarding the distribution of inheritance for heirs who change their gender in order to create legal certainty.
