Abstract
This research aims to provide a juridical analysis of the resolution of child abuse cases, with a particular focus on the case registered under Case Number 183/Pid.Sus/2024/Pn.Mlg. The study explores the application of criminal law in addressing child abuse, encompassing the investigation, prosecution, and trial phases.The research adopts an empirical juridical methodology, combining legal approaches with field-based observations. Primary data were collected through direct observation of the trial proceedings for Case Number 183/Pid.Sus/2024/Pn.Mlg. The author also conducted interviews with key stakeholders, including the presiding judge overseeing the case and the legal counsel at the firm where the author interned. These interviews were designed to gather comprehensive insights into the handling of child abuse cases. Additionally, primary data were supplemented by examining the official court ruling, Decision Number 183/Pid.Sus/2024/Pn.Mlg. To enhance the primary data, the author also
utilized secondary data, which included various legal materials relevant to the
research topic. These secondary materials encompassed the Indonesian Penal Code (KUHP), Law Number 35 of 2014 on Child Protection, and other legislation governing special criminal law related to child protection. Furthermore, additional legal sources, such as legal doctrines, journals, articles, and other relevant secondary legal materials, were used to enrich the study. This research is expected to contribute to the development of more proactive and responsive legal policies regarding child abuse issues.
