Even though the Mortgage Rights Law has been recognized as an answer to the problem of legal certainty over land rights, it still does not cover all sides, including the issue of the weakness of the debtor's legal position if placed in the same position as the creditor. The formulation of the problem studied in this thesis, namely How is the legal protection for heirs against the estate that has the status of a mortgage? The research method used in this thesis is Normative Juridical with a Statue Approach to the Civil Code and UUHT and Conceptual Approach with a study of legal protection. The results and discussion are that in connection with the inadequacy of the regulation of the transfer of the object of Mortgage Rights due to inheritance, it is necessary to add Articles or at least regulate more specifically in an implementing regulation regarding the auction of executions related to inheritance and disputes that often occur in the discussion of the auction of the object of mortgage rights based on Article 6 of the UUHT by being informed as a form of guarantee of legal certainty that the heirs of the deceased debtor must also get the same treatment
