Abstract
An unlawful act is when someone does something that violates the law, infringes on the rights of others, or causes harm to others. Acts of unlawful conduct in the procurement of goods require a process of proof in civil cases to determine who the aggrieved parties are in the investment of those goods. This research aims to understand and analyze the implementation of the resolution of unlawful act disputes in case number 275/Pdt.G/2023/PN.Mlg. The writing method in the preparation of this final assignment uses the empirical juridical research method. In the a quo case, the process of resolving the unlawful act dispute has been carried out as it should be. This means there is no inconsistency between theory and practice. In the lawsuit with registration number 275/Pdt.G/2023/PN.Mlg, the dispute over unlawful acts regarding the procurement of goods began with the reporting of the Defendant for unlawful acts in the procurement project. However, the Defendant fled and was found in the Blimbing area of Malang. The Malang District Court, in its first-instance decision, partially granted the Plaintiff's lawsuit, stating that the Defendant had committed unlawful acts related to the procurement project and ordered the Defendant to pay compensation of Rp. 17,242,367,541.00. However, several matters need to be considered moving forward, and it is very important for the Plaintiff to ensure a clear legal status every time they file a lawsuit. And the organized preparation of evidence.
