Abstract

The development of an increasingly pluralistic society gives rise to a legal event. This has led to many legal events occurring as a result of past violations, namely breaking through the rail gate after the doorstop had gone down. As a result of violations that break through the rail gate, the risk of accidents for motorized vehicle users arises. Therefore, the author will discuss the three formulations of the problem as follows: What are the factors that cause legal violations of railroad crossings in East Java, What is the role of law enforcement officers against violations of railroad crossings in East Java, and What only obstacles in the enforcement of criminal law against violations of railroad gates in East Java and their solutions. The research method in this writing is using sociological juridical type, which is studied using 3 (three) methods, namely: observation method, literature study, and data analysis. The factors that cause the occurrence of legal violations against railroad crossing gates in East Java are human factors (human error), environmental factors, environmental factors, facilities and infrastructure factors. In the role of law enforcement officers against violators in the form of education to the community (Dikmas Then), Guidance and Counseling (Binluh), persuasive, and repressive. And obstacles in the enforcement of criminal law in violations in terms of being seen from the law enforcers themselves, seen from the behavior of the community as well, and also seeing whether the facilities and infrastructure are adequate or not.
