Abstract

The spread of Covid-19 in Indonesia is undeniably affecting various aspects, not only social and economic, the judicial system is also affected. With the appeal regarding physical distancing in Indonesia and Large-Scale Social Restrictions (PSBB) in several regions in Indonesia in order to suppress the spread of COVID-19, law enforcers made an MoU (Memorandum of Understanding) agreement between Mahkamah Agung which, represented by the Direktur Jendral Badan Peradilab Umum, kejaksaan agung was represented by the jaksa agung muda tindak pidana umum, and KEMENKUMHAM RI was represented by Plt. Direktur Jendral Pemasyarakatan Kementrian Hukum dan HAM abiut conducting trials via teleconference. Efforts to carry out online trials during the Covid-19 pandemic are considered a progressive step, in solving the problem of case stagnation due to the spread of Covid-19, but behind the implementation of online criminal court trials, it turns out that there are obstacles in the process. The purpose of this study was to determine the effectiveness of the law in the cooperation agreement between the 3 institutions and to find out the validity of evidence in criminal cases related to online trials during the covid-19 pandemic. The research method that the author uses is a normative juridical approach, with data collection techniques through a library research model. The results of the study are that it is not effective if the trial of criminal cases is carried out online and the evidence in criminal cases is legal according to existing laws and regulations
