Abstract

Based on the provisions of Article 23 letter C which states that the authorized official can apply for the annulment of a marriage as long as the marriage has not been terminated. However, in Determination Number 3043/Pdt.G/2018/PA.Badg has annulled the marriage of Sheraz Khan and Rezina, in which the marriage had already been broken due to death. Therefore, in this study the researcher determined the formulation of the problem as follows: First, namely the analysis of Determination Number 3043/Pdt.G/2018/PA viewed from a positive legal perspective, and Second, knowing the legal consequences arising from Determination Number 3043/Pdt.G/ 2018/PA is viewed from a positive legal perspective. This study uses a normative juridical research method with a case and law approach. The results of this research are the panel of judges based on Article 23 letter C of Law Number 1 of 1974 concerning Marriage and a summons from Rezina's family who denies having become a marriage guardian in their marriage, without any proof of this. In this case, the position of the Petitioner should not be accepted because the marriage has been broken due to death prior to the application for annulment of the marriage. So the status of Sheraz Khan as from Rezina is one of the heirs and is entitled to part of the wealth in marriage or joint property.
