Abstract

The rights for workers with a specific time work agreement (PKWT) are regulated in the 1945 Constitution in Article 27 Paragraph (2) and 28D Paragraph (2) which explains that everyone has the right to freedom to work. However, the regulation in this case is contrary to the 2003 Manpower Law, Article 59, where in this article it is explained that certain time workers (PKWT) must be completed within a short period of time and only have a limited period of work, namely a maximum of 3 (three) years. This research uses normative juridical research methods with the aim of finding out the regulations and rights and obligations for workers and entrepreneurs. The results of this research show the regulations in the Employment Law and the 1945 Constitution. Efforts that can be made are by making legal reforms to guarantee protection for workers as well as forms of legal certainty and protection for workers by implementing an appropriate work agreement that Everyone has the right to choose work without a time period, and to get justice for Certain Time Workers (PKWT). This research suggests the need to confirm regulations regarding the rights of PKWT workers in order to create justice for both workers and employers.
