Abstract

The inconsistency between the Notary Law (UUJN) and the Money Laundering Criminal Law (UU TPPU) regarding the obligation to maintain the confidentiality of deeds held by Notaries, creates a normative conflict between UUJN Article 4 paragraph 2, Article 16 paragraph 1 letter f, and Article 54 paragraph 1 with UU TPPU Article 28, Article 41 paragraph 1 letter a and paragraph 2, Article 45, Article 72 paragraph 1 and paragraph 2. Therefore, this research analyzes the Legal Force in UUJN Regarding the Obligation to Maintain the Confidentiality of Deeds with the Position of Notaries as Reporters of Money Laundering Crimes in UU TPPU and the Implementation of Notary Oaths and Obligations in UUJN If in UU TPPU Notaries are Required to Disclose the Confidentiality of Deeds. The type of research used is normative juridical with legal material collection techniques through literature study. The results of this research show that regarding the obligation of Notaries to maintain the confidentiality of deeds stated in UUJN, especially in Article 4 paragraph 2, Article 16 letter f, and Article 54 paragraph 1, the legal force of UUJN regarding confidentiality of deeds becomes weak when referring to UU TPPU, specifically in Article 28, Article 41 paragraph 1 letter a and paragraph 2, Article 45, and Article 72 paragraph 1 and 2, because if money laundering occurs, UU TPPU takes precedence over UUJN. The implementation of oath and obligations of Notaries regarding the confidentiality of deeds stated in UUJN remains the responsibility that must be carried out by Notaries. UUJN, which is the main guideline for the Notary profession, must be adhered to under any circumstances. However, the implementation of oaths and obligations of Notaries regarding confidentiality of deeds in UUJN can be overridden by UU TPPU.
