Abstract
The right of the defendant stated in the rule of rule number 50 (the bill of law on Crime matters)/ KUHAP up to rulec number 68 in which one of them mentioned his or her right to get such accompanion in facing the problem they have and unfortunately it is only mentioned in rule number 56 of (the bill of law on Crime matters)/ KUHAP verse (1) and (2) namely: 1. This is applicable if the defendant do the crime in which it put him into capital punishment of 15 years punishment or more and those who are sentenced into five years punishment and they do not have lawyer they pay faor the help them, the related official should find or appoint the lawyer to help the defendant facing all the investigation process. 2. Each lawyers appointed by government to help those defendants will give free of charge help as what mentioned in verse 1. Based on that background, the writer wants to analyze the The Yuridical-sociological point of view on the defendant right in getting the lawyer accompanion (a study case in the state Court in Kediri regency) which are mentioned as follows: 1.How is the right fulfilment of defendant sentenced to five years or more in getting lawyer accompanion in State court of Kediri regency? 2.What problems faced by the judge in fulfilling the right of getting lawyer accompanion for those defendants and what efforts done to solve those problem? This study used yuridical-sociological approach. The location of the study is in the state court of Kediri Regency. The data collection methods of this study are observation, interview, and library research. The sampes of this study are all the judges in the state court of Kediri regency. The data are analyzed by using field research.
