Abstract
Indonesia is a country based on regulation, it is stated in section 1 verse (3) of Indonesia Regulation (UUD 1945), said that everything base on banded and forced law. The Republic of Indonesia is democratic country based on Pancasila and UUD 1945, there is no centralize power on a group but tent on democracy. Government regulation no. 31 / 1997 ruled on military judicature, especially psychotropic abuse conducted by TNI-AD. There is still TNI member broken the psychotropic regulation, and the writer are interested to research this problem. How military judicature competence coping the psychotropic abuse by TNI-AD member, data collecting technique with interview and observation, other published data, then arranging in qualitative descriptive method, mean describe all data in the real condition. The research results show that Military judicature III-12 Surabaya, use absolute competence to handle psychotropic crime by TNI-AD. Military judicature conducting an investigation, and prosecution at court, and give military punishment as government regulation No. 31/1997, the military judicature staffs have responsibility to take a truthful and fair punishment even they facing military staff criminal.
