Abstract

This study aims to analyze the regulation of cryptocurrency usage as a digital asset and alternative collateral right in Indonesia. This normative legal research uses a statutory and conceptual approach. The main data sources originate from relevant primary and secondary legal materials. The results show that cryptocurrency regulation in Indonesia is quite progressive, however regulatory revisions are needed to provide legal certainty. The use of cryptocurrency as collateral still faces challenges and lags behind developed countries. Specific regulations are needed in this regard with a balanced approach to protecting public interests without inhibiting innovation. The development of cryptocurrency regulations in Indonesia still faces challenges. A clear legal framework regarding its status and implementation is needed. The regulation of crypto assets as collateral instruments is also necessary to protect public interests and support blockchain technology innovation. The government needs to follow up on the Virtual Currency Bill and revise existing regulations or ratify new regulations regarding cryptocurrencies. Specific regulations related to the application of crypto assets as civil collateral in Indonesia are also needed. In formulating regulations, the government can benchmark the United States and other developed countries so that they are integrated with the national legal and financial system without inhibiting innovation in blockchain technology and crypto.
