Abstract

But together with change of time eventually a government do ordering to tradition miner with manner that in do duty they must cooperated with KUD bogo sasono appointmently have been decided by Pertamina with arrangement between pt. Pertamina (persero) with KUD bogo sasono number: 893/000000/2004-so. From background above will be disscuss some problems, which are. 1.How is a process of right giving for tradition miner in Kedewan district of Bojonegoro? 2.How is right tranfering from tradition miner to country? 3.How is right surety for tradition miner? With use approach methode of yuridis sosiologis that is disscuss aproblem based on institution appointment also be related with lawteory and see areality that be main problem in this research. The result of research indicate that a miner is member of KUD bogo sasono and they must give their mining produce to KUD bogo sasono until 2009 year because the oil price from KUD bogo sasono is regarded not enough, they make mining produce by their selves. Whereas kud bogo sasono did long of cooperating contrac. With pertamina at January 15, 2007. Society request to KUD bogo sasono so that want increased oil price 250.000, but be refused by pertamina with reason that a content of oil this during which they send to KUD is very little. Which specification every one drum of oil raw that be sent after process of water separation only content 20 – 30% oil. Whereas another shaped a water, so if a society ask price 200.000 pertamina will be compensastied. A miner tradition also build mining cooperation that is kedewan putra jasa jaya a cooperation with members 423 people until now. Law agency number 28/bh/kdk 13 27/1999. With do it, be hoped can reach changing. And this time all of direction waiting decition from central government with be beriden new rule.
