Abstract
The object of this study is about the legal guarantee of public rights in public service by the East Java Provincial Regulation number 11 of 2005 on public services and the implementation of these local regulations and constraints in its implementation in the Office of Civil Registration in Malang. The method will be used in this study is the method of Juridical Sociological approaches to empirically study the reciprocal relationship between law and other social phenomena. This method we use because the subject will be closely linked to the juridical law and examines some of the rules relating to public service. While the importance of sociological research to determine the implementation and the constraints in the implementation of public service as a fulfillment of basic rights of citizens / public. As for the public rights are guaranteed and regulated in the public service by the East Java Provincial Regulation No. 11 of 2005 on Public Service that is the right to participate in making the Public Service Standards, to supervise the implementation of public service, to obtain compensation if it does not get service not in accordance with the standards of service, complain when the public service does not comply with the agreed service standards for service providers and the public Service Commission for a settlement, and the index of community satisfaction. Implementation of the East Java provincial regulation number 11 of 2005 on public service in KK and ID card services in Malang City Population Office, was not in accordance with the existing service standards. Because there is no certainty of completion time, cost quite varied and not in accordance with the standards of public services that have been defined. Because of what is delivered by service providers that the services they provide are very good, but poorer in reality not the case. From a matter of cost alone is enough price that varies from 5 thousand to 25 thousand in each district. Not to mention the solution which is also a matter of time nothing is certain, it is a cause of uncertainty for the people who finally dared people to pay more quickly as long as it is completed. But the standard that should be made in the reference by the organizers of the services in their activities was stout ignored. Constraints faced by the organizers pengemlementasian service in the East Java Provincial Regulation No. 11 of 2005 concerning public service, for in Malang said is not experiencing any problems. This is dikarenaka pendudukung facilities are quite adequate and personnel resources which also have the competence. But the culture of the officials who still do not have a high awareness of the role and functions as a servant of the state, eventually inconsistencies occurred in implementing the existing regulations. Urging all about setting up this public service to be regulated by an Act in the form of regulations that can protect the basic rights of citizens in public service in particular. Because until now there is still no higher rules of public service.
