Abstract
According to section 15 Rule No.30 / 2004, Notary has law responsible to authentic certificate. That’s why there formed Regional Monitoring Committee (MPD) which watched notary responsibility in making authentic certificate. It is interesting to discuss how notary responsibility and competence in making authentic certificate, also monitoring by MPD related with authentic certificate. This research aimed to find out notary responsibility and competence, also monitoring mechanism by MPD Malang to Notary in making authentic certificate. In the research, the writer did socio-juridical approach. The writer used primary data, consisting of interview and documentation at research location, that was MPD Malang, and secondary data from literature discussion which strengthen the existing data. In data analysis, the writer used descriptive qualitative data. From the research, Notary competence in making authentic certificate : making authentic certificate as the rule stated, consisted of formal agreement certificate and free agreement certificate ; make legal of under-law certificate, giving law illumination. If the notary didn’t fulfill the responsibility in making authentic certificate, the notary would be sanctioned. Monitoring mechanism by MPD are : planning, action, and evaluation. The writer suggested that MPD should be increased their performance professionally related with monitoring. Then for the government, it would be better if the government gave material support to MPD in order to do their job well. For notary, notary should did the authentic certificate making as the procedure and law existed, and for another researcher, there would be better if they study another aspect of these research
