Abstract
One of function of soil in human life is a settlement. Need of settlement always increase that caused by society growth at each of area. Need of soil is always constant, so the soils that has been used for agriculture become settlement. Developer always seeks new soil for settlement soil for their business. The new soil for settlement include the village soil. The method of this research is Yuridis Sosiologis, that was done in real society with purpose to find fact, find problem, and then identify the problem, and finally find the conclusion. The exchange of soil is one of way to get soil trough discharging the right. So have to given something to owner. So exchange soil between Jerukgamping Village with PT Eka Permata Surya Sentosa (developer) have to supply healthier, more productive, larger replacement soil. Not only that, developer also have to give money to Jerukgamping Village. So that exchanging soil does not damage Jerukgamping Village and can help economic of Jerukgamping Village. Exchange soil is done with discharging the right. This way do, because the soil that bargain is right soil and the owner ready submit it, but condition of developer does not have right become right subject from the soil.
