PANDANGAN TOKOH MUHAMMADIYAH DI MALANG RAYA TENTANG NUSYUZ SUAMI TERHADAP ISTRI

ABSTRAK
Dewasa ini pembahasan terkait nusyuz suami merupakan salah satu istilah yang sangat jarang dibahas, hal ini dikarenakan adanya budaya patriarki yang marak dalam kehidupan masyarakat, sehingga dapat mempengaruhi pandangan seseorang, terutama dalam aspek keluarga, dimana kebanyakan orang menganggap nusyuz hanyalah tertitik pada istri bukan pada suami. Konsep nusyuz dalam hukum islam sebenarnya tidak melegalkan adanya perbuatan kekerasan. Sementara itu, perbuatan suami yang memukul istri nya atau bentuk kekerasan lain seperti penelantaran terhadap istri maka dapat dinyatakan sebagai nusyuz suami terhadap istri. Penelitian ini mengkaji pandangan para tokoh dan aktivis Muhammadiyah berkaitan dengan konsep nusyuz suami dan kaitan nya dengan penalataran rumah tangga dalam UU PKDRT. Sehingga penelitian ini bertujuan untuk membangun pemahaman mengenai makna nusyuz yang dianggap bias gender. Secara historis pemahaman terkait interpretasi terhadap suatu ayat hukum dipengaruhi oleh kondisi social, budaya, politik para penafsirnya.

ABSTRACT
Nowadays discussions related to husband's nusyuz are a term that is very rarely discussed, this is due to the patriarchal culture that is rampant in people's lives, so that it can influence a person's views, especially in the family aspect, where most people think that nusyuz only applies to wives, not husbands. . The concept of nusyuz in Islamic law does not actually legalize acts of violence. Meanwhile, the husband's action of hitting his wife or other forms of violence such as neglecting his wife can be declared as nusyuz of the husband towards his wife. This research examines the views of Muhammadiyah figures and activists regarding the concept of husband's nusyuz and its relationship to household management in the PKDRT Law. So this research aims to build an understanding of the meaning of nusyuz which is considered gender biased. Historically, understanding regarding the interpretation of a legal paragraph is influenced by the social, cultural and political conditions of the interpreters.
