Abstract

A fishery production sharing agreement is an agreement to share the net profits from a vessel at sea between fishermen and the owner. This research aims to determine the pattern of profit sharing agreements between fishermen and ship owners in Bandaran Village, Tlanakan District, Pamekasan Regency and to determine the implementation of profit sharing agreements between fishermen and ship owners in Bandaran Village, Tlanakan District, Pamekasan Regency. This type of research is empirical legal research. Data collection uses observation techniques, interviews and is supported by literature study. The results of this research show that 1. The pattern of fishery product sharing agreements made by fishermen and owners in Bandaran Village, Tlanakan District, Pamekasan Regency, is a pattern of agreements that have been carried out for generations, namely by making verbal or unwritten agreements and mutual trust in each other. . There is no time period but the agreement can end at any time if something happens that causes a breakdown in the relationship between fishermen and ship owners. If there is a default, it is carried out by deliberation. 2. Implementation of fishery product sharing agreements made by the ship owners between the fishermen. The division is into 3 parts, namely the ship owner gets 1/3 of the share if 35% is presented to the ship owner and the fisherman gets 2/3 of the share if presented 65% for fishermen. However, 2/3 of the portion is further divided according to the role or role each fisherman is assigned to the ship in one go to sea.
