Abstract

Divorce is something that is hated by Allah SWT, therefore the marriage law adopts the principle of making divorce difficult. However, under certain conditions divorce is allowed for reasons that have been regulated by law. If there is a dispute between husband and wife, they can file for divorce in court. In the case of filing a lawsuit with the court, the parties can submit a defence through mechanisms at the trial. However, it is also possible that one of the parties does not come to court on the pretext that they have agreed to divorce. In these circumstances, the judge must still prove the existence of the reasons set out in the law for divorce. The absence of one of the parties to the court can also accelerate the process of resolving divorce cases. Therefore, the judge must try to reconcile the two parties even though one of the parties is not present at the trial. the purpose of this research is to find out how the process of divorce with a verstek decision. This research was conducted at the internship office using the data collection method of observation and literature study.
