Abstract

The existing legal regulations for Peer-to-Peer Lending Based on Information Technology (LPBBTI) still cannot effectively provide legal protection to the public. Among the regulations governing this are Law Number 21 of 2011 concerning the Financial Services Authority, Financial Services Authority Regulation (POJK) Number 10/POJK.05/2022 concerning LPBBTI, POJK Number 6/POJK.07/2022 Regarding Consumer and Community Protection in the Financial Services Sector, and the Board of AFPI Decree Number 001/TAP/AFPI/X/2021. This research aims to identify the weaknesses of the existing legal regulations for LPBBTI in Indonesia and to analyze the reconstruction of LPBBTI regulations in Indonesia. This research is a normative juridical study using the statute approach and conceptual approach. Legal materials include Law Number 21 of 2011 concerning the Financial Services Authority, Financial Services Authority Regulation (POJK) Number 10/POJK.05/2022 of 2022 concerning Peer-to-Peer Lending Based on Information Technology (LPBBTI), POJK Number 6/POJK.07/2022 concerning Consumer and Community Protection in the Financial Services Sector, and the Board of AFPI Decree Number 001/TAP/AFPI/X/2021. Legal materials were collected through documentation, and the data analysis method used was content analysis. The results of this research reveal that the legal rules for LPBBTI are regulated by Law Number 21 of 2011 concerning the Financial Services Authority, POJK Number 10/POJK.05/2022 of 2022 concerning LPBBTI, POJK Number 6/POJK.07/2022, and the Board of AFPI Decree Number 001/TAP/AFPI/X/2021, which have several weaknesses: the legal defense authority of the Financial Services Authority (OJK) does not align with its tasks and functions; there is no regulation on the use of emergency contacts; there is still a lack of rules regarding the protection of personal data; and there is no POJK on the maximum limits for interest rates and other fees. The necessary reconstruction includes: removing the rule on OJK's authority to conduct legal defense through civil lawsuits; adding rules on the use of emergency contacts; revising rules on the protection of personal data; and adding rules on the maximum limits for interest rates and other fees in POJK.
