PROSES PENYELESAIAN SENGKETA WARIS TERHADAP PUTUSAN NIET ONTVANKELIJKE VERKLAARD PADA PERKARA Nomor : 1110/Pdt.G/2023/PA.Kab.mlg

An inheritance dispute is a dispute or conflict that arises when there is a disagreement or conflict between the parties or heirs who have the right to inherit the property or assets of someone who has died. Inheritance disputes themselves are usually related to the division of inherited assets, determining or determining who has inheritance rights, or legal issues related to the inheritance management process. Inheritance disputes often require resolution through the legal system or through a mediation process so that the problem can be resolved fairly and in accordance with applicable law, for example the case of handling or resolving an Inheritance Dispute regarding the Niet Ontvankelijke Verklaard Decision or a decision not accepted in Case Number : 1110/Pdt.G/2023/PA.Kab.mlg at the Malang Regency Religious Court. The aim of this research is to find out the process of resolving the Inheritance Dispute regarding the Niet Ontvankelijke Verklaard Decision in Case Number : 1110/Pdt.G/2023/PA.Kab.mlg.
This research uses a type of empirical legal research using a sociological approach method. The data used by researchers in this research only uses primary data. In this case, the author's role is to resolve disputes, namely analyzing the lawsuit, making and registering a power of attorney, attending the first trial until the verdict hearing. The conclusion from the results of the research and discussion made by the author is that it can be concluded that the panel of judges accepted the exception from the defendant and decided this case with a decision of NO (Niet Ontvankelijke Verklaard) or it could be said that it was not accepted. As a country based on law, the government of course plays a role in resolving dispute cases through law enforcement agencies. The government appoints a legal institution to resolve dispute cases, such as the inheritance dispute case in Case Number 110/PDT.6/2023/PA.Kab.mlg.
