Abstract

This research discusses the process of Dispute Resolution of Default Lawsuit in Case Study Number 112/Pdt.G/2023/PN Sby. The purpose of this research is to find out how the Dispute Resolution of Default Lawsuit Case Study Number 112/Pdt.G/2023/PN Sby in Court and explain the stages carried out in handling cases through trials. The research method used in this research is empirical juridical legal research. The data used by the author in this research are primary data and secondary data with data collection techniques by means of observation, interviews and documentation. The author in analyzing the data uses a qualitative descriptive approach. Descriptive research is the author trying to describe research activities carried out on certain objects clearly and systematically, as well as conducting exploration with the aim of accurately explaining the results of the research. The results of this study after the settlement in court are based on the results of the Surabaya District Court's decision that the Panel of Judges granted part of the plaintiff's claim. In conducting an agreement, it is better to use a written agreement not only an oral agreement, in order to avoid any act of a Breach of Promise or Default.
