Abstract

Land disputes have a bad impact on various aspects, one of which is in the field of law, which causes legal uncertainty over the disputed matter. The background of the Kampung Baru land dispute is temporary, so residents are prohibited from building permanently. The Trenggalek local government wants to move the people of Kampung Baru to rusunawa that have been developed for a solution so that residents have legal residence. This research uses the Empirical Juridical research method, which is direct research into the field, namely in Kampung Baru, Tasikmadu Village. The results of this study stated that the ownership rights of the land occupied by the residents of Kampung Baru were legally owned by the Regional Government. There are some residents or individuals who maintain that the land can be fought for or become their property, even though it is clear that the land inhabited by the people of Kampung Baru is currently legally owned by the Trenggalek Regional Government and the Kampung Baru wa rga can only live temporarily. This research has not found a solution, because the Regional Government is less firm regarding the relocation of Kampung Baru, the Government should conduct socialization or deliberation with residents first regarding the planning of the construction of the rusunawa. So that neither party is harmed.
