Abstract

It is a logical consequence of rights and obligations if the marriage contract has been declared valid. However, the rights and obligations in the household of married couples with mental disabilities are often considered a problem. A review or perspective is needed to understand the problem. Mubadalah interpretation is one of the reviews that can be used to understand it. For this reason, this study aims to describe and analyze the rights and obligations of husband and wife in the household, from the perspective of Mubadalah interpretation.
The research approach used is library research. The research data was sourced from the book “Qira’ah Mubadalah: Tafsir Progresif untuk Keadilan Gender dalam Islam” by Faqihuddin Abdul Kodir, published by IRCISOD Yogyakarta in 2019. The collected data is then analyzed using discourse analysis techniques.
The results of the study concluded that the rights and obligations of husbands and wives with mental disabilities from the perspective of tafsir mubakan are returned to the perspective of gender, where women or wives are encouraged to be filial to their husbands, while husbands are not encouraged to do the same, are principally eliminated in the perspective of tafsir mubadalah. If one party in the household (wife/husband) cannot fulfill his rights and obligations, then one of the other parties may help to fulfill them. This interpretation is based on Islamic teaching sources that explain the five pillars of marriage, including commitment to the bond of promise, pairing, mutual comfort and willingness behavior, treating each other well, and counseling together.
