Abstract

Obstruction of Justice is an act of obstructing the legal process which has been regulated in Article 221 (1) to 2 of the Criminal Code Obstruction of justice is a criminal offense because it obstructs the law enforcement process and damages the reputation of law enforcement officials. Obstruction of justice also jeopardizes the legal system and disrupts the normal functioning of the justice system. The writing method used to examine this legal problem is the juridical-normative method carried out by the author in this study to analyze the qualifications of Obstruction of Justice. The act of Obstruction of Justice or actions taken by a person or group of people to obstruct, thwart, or interfere with the process of investigation, trial, or delivery of justice by the legal system. the purpose of obstructing the legal process which shows that the act of Obstruction of Justice is an act that is classified as a criminal offense with elements of intent (dolus delict). For this reason, it is necessary to strengthen the professionalism of law enforcement officials in taking action against acts of obstructing the investigation process and making this offense strong and not ruled out.
