Abstract

Alcoholic beverages are drinks thet contain the compound ethanol (C2H50H), produced through fermentation and distlillation processes. The trede of alcoholic beverages can be circulated in designated places, according to regulatons. In the case of selling alcoholic beverages, a permit is required, as explained in article 22 of the Minister of Trade Regulation No. 20 of 2014 concerning Control and Supervision of the Procurement, Circulation, and Sale of Alcoholic Beverages. However, in current practice, alcholic baverages can be found circulating through electronic systems (e-commerce), which is quite ambiguous from a legal perpective. This is because there is no mention in positive law whether alcoholic beverages distributed through eloctronic systems can be traded ini the electronic circulation. With this ambiguity, there is currently no clear legal basis for penalizing the online circulation of alcoholic beverages. There is no explanation regarding licensing and supervision for alcoholic bevarages through social media. According to law No. 39 of 2007 concerning amendments to Low No. 11 of 1995 concerning Excise, alcoholic beverages are considered goods that require supervision of their circulation, and their consumption needs to be controlled. Supervision can be carried out in the scope of advertising alcoholic beverages through any mass media to ensure compliance with regulations stated in government regulations with the information or statements in labels and advertisements circulating in society.
