Abstract

This article aims to seek an explanation regarding the application of the burhānī approach in the Islamic legal reasoning of the Majelis Tarjih dan Tajdid Muhammadiyah to deal with the policy of social service especially related to the case of childcare. It implements the qualitative research method to analyze documents of the Majelis Pelayanan Sosial Muhammadiyah’s policies as the primary data. The data is investigated by Nvivo 12 Plus. The result of analysis, furthermore, is interpreted and discussed by means of the approach of the philosophy of Islamic law which connects to the discourse of maṣlaḥah, maqāṣid al-syarī’ah, and qawā’id fiqhiyyah. This article finds that due to the burhānī rationales, Muhammadiyah has prioritized childcare within a family as a fundamental social unit in society. This fundamental institution has obliged parents to fulfill parenting duties that prioritize the kinship system (kafalah) without undermining children’s social environment. This article argues that, through this childcare case, Muhammadiyah tends to comply with laws and regulations regarding childcare and protection.
