Abstract
Indonesian Police ( POLRI ) has importantrole on the achievement of national stability whereas its function bisdes protecting the society also function to stabilished discipline, and legal institution to produce driving license ( SIM ) in this case as the executor is traffic unit ( Sat Lantas ) Polres Malang, as it is stated in governmental regulation ( Peraturan Pemerintah ) No. 44 years 1993. in its capacity to produce driving license, there is scalper practices in which driving license can be obtain without carriying the normal procedures as stated in law No. 14 years 1992. State income from this matter is classified as state revenue non-taxes in effect for indonesian police. problem formulation in this matter is how scalper practices in he making of driving license can take place in Sat Lantas Polres Malang and how does Polres Malang deal with these scalper practices, in order to gain objective for this experiment implicitly which in to dicover scalper practices took place in Sat Lantas Polres Malang and how Polres Malang handling this scalper practices in the making of driving license. Using sociological juridical as writing method of this experiment with legal composition extracted from primary legal material which is law No. 14 years 1992, PP No. 44 years 1993, secondary legal material which contain information on primary legal material and tertiary legal material which contain indication for primary and secondary legal material. data collection technique is using observation technique and interviews followed with descriptive analysis data analysis technique. Based on the result of the experiment, it is known that scalper practices in Sat Lantas Polrea Malang has done by several parties, comprises of driving license publisher official, parking official, people who become scalper as their main occupation, all of them has been making driving license in a quick manner without following the standard procedures. the way Polres Malang handling scalper practices is by doing random raid in the environment of Sat Lantas Polres Malang, giving strict sanctions for official involve in scalper practices and releasing advice for not using scalper in making driving license.
