Abstract

Wasiat wajibah is a testament where is given to parent and nearest family whose did not have allocation of wealh caused dzawil ahram, mahjub, or mahrom whose the parents is a a recipent allocation of wealth from legacy. In Islam’s Ulama opinion is any difference about this Wasiat Wajibah. The difference opinion in Islam ulama is about use nasak­mansukh Al­qur’an al­ Baqarah : 180 and Prophet said “ la wasiatan li wariin” as legality of this testamen. And difference too with Kompilasi Hukum Islam. In this research, writer want to find out and want to know about wasiat wajibah concept in Fiqh and KHI ( Kompilasi Hukum Islam ). Explicit the true concept abaot this testament in KHI. This is a library research, collecting the data from this search use induktif­comparatif methode. Use al­qur’an and hadits as primary data. And the secondary data as complilentary of the primery data. Finaly from this research result that KHI in Indonesia have diferent rule about this testamen than The rule in Fiqh as islam law. The different located in whose the recipent of allocation of wealth from Wasiat Wajibah.
