Abstract

Ahsanurrijal, 201310020311005, "Inheritance Rights of Children Outside Marriage according to the Civil Code (KUHPdt) and Compilation of Islamic Law", Thesis, Malang: Department of Akhwal Syaksiyah, Faculty of Islam, University of Muhammadiyah Malang. Malang 2019. This study aims to determine the position of children outside of marriage about the ratification / recognition of child status and inheritance rights according to KHI and to know the position of children outside of marriage about the ratification / recognition of child status and inheritance rights according to the Civil Code and Decision of the Constitutional Court. The results showed that in Islamic law and jurisprudence, children born to mothers outside of legal marriages, the child only had a relationship with his mother and his mother's family, and with the biological father did not inherit, live and guardian's rights to his child and In Civil Law, non-marital children who have a legal relationship with their biological father as long as the child is recognized by his father, and if it is not recognized by his biological father, the child does not have civil law with his father such as inheritance rights, guardianship rights and livelihood rights.
