Nowadays phenomena existed in Indonesian Society is the importance of eradicating waif problems which has larger amount and concerned life. Since children are the next person who continues our country’s destination. In handled this waif, the government has important role and responsible to the prosperity of waif, especially orphan waif. Though waif care has been done by the government, but the amount of waif, especially orphan, get larger. That’s the major reason to do analysis in implementation of waif care by Orphan House in Rule No.23 / 2002 about Children Protection section 37 art (2) (Cases Study at Orphan House Institution Malang City) Above explanation showed the limit of analysis, there could be concluded the statement of problems : How the implementation of waif care by Orphan House at Malang City according Rule No.23 year 2002 about Children protection section 37 art (2) and what the problems of orphan house in taking care the waif. In doing analysis, the writer took socio-juridical approach by paying attention to the law application. Data collection came from Orphan House Institution – Malang City. Data Collection technique was done by interview, documentation, and existing rule. Data collected was analyzed by analytical description method, which focused on law phenomena in its practice, related with the existing rule. According to the research, at implementation of waif care by government in the rule No.23 / 2002 about Children Protection section 37 art (2), there could be concluded : waif care should be done by government, especially Social Institution – Orphan Department Malang City. But in fact, the government move their responsibility to the orphan house under the government. In taking care the waif, the government only giving fund about food budget, productive-economic budget, waif need, and for education, the government didn’t have the fund. Orphan Institution in taking care the waif, especially orphan, giving education, religion, and skill. There were two problems faced by Orphan House Institution under government responsibility in taking care the waif, especially orphan. From mental side and budget for taking care the waif, especially who has no parents.
