Abstract

Work agreement represent result of consultation contains rights and obligation of worker and entrepreneur in the company. In fighting for each rights had, worker merge into a labor. In operating a labor federation had role to struggle rights had by worker, particularly in the preparation of work agreement. Problem formulation of the research among others how process of work agreement at PT. Sasa Inti Gending, how role of labor federation cigarette tobacco food and beverage Probolinggo regency (FSP RTMM) at the process, and what kind of factors become resistor and supporter of FSP RTMM in execution of its role. The objective of the research among others to know preparation process of work agreement at PT. Sasa Inti Gending and role of FSP RTMM in the process, and resistor and supporter method of FSP RTMM in the execution of the role. The research use method of sociological juridical approach, represent research method by seeing role of FSP RTMM at the preparation process of work agreement. By data collecting technique namely interview with entrepreneur and labor federation, and direct observation to PT. Sasa Inti Gending, Labor federation of Cigarette Tobacco Food and Beverage (SP RTMM) and FSP RTMM, as location to take primary data. Then data of research result to be analyzed descriptively use secondary data namely result of library study and documentation. The research obtained result that some preparation process of work agreement at PT. Sasa Inti Gending, had appropriated with Decision of Labor and Transmigration Minister No. Kep.48/MEN/IV/2004 about a way of Preparation and Legalization the Regulation of Company and Preparation and Register of Work Agreement. Role of FSP RTMM in the preparation process of work agreement among others by training and counseling around work agreement, arrange framework of work agreement, discuss draft of work agreement would be proposed to the entrepreneur, survey of life properly to determine subsidy would be proposed in work agreement, and giving recommendation at contain of work agreement. In the implementation of the role there were resistor factor among others difficulties to determine training schedule, lack of training about work agreement, low of human resources SP RTMM, delay of work agreement preparation at PT. Sasa Inti Gending was conducted by entrepreneur, difficulties of determine fixed price at determination of standard of life properly, and lack of participation of SP RTMM in asking recommendation. Besides, there were supporter factor, among others available fund to cost every activity and participation of member of labor federation. Conclusion, that preparation process of work agreement at PT. Sasa Inti Gending had appropriated with regulation of law. Role of FSP RTMM in the preparation of work agreement at PT. Sasa Inti Gending with SP RTMM. In the implementation of FSP RTMM role there were resistor and supporter factor. Suggestion, in the preparation of work agreement entrepreneur shouldn’t be wait for asking SP RTMM and training about arrange of work agreement should be often to be conducted, and SP RTMM as party relate directly with entrepreneur should be more active in asking recommendation around work agreement to FSP RTMM.
