Abstract

The purpose of this study was to determine the suitability of buying and selling istishna ', in the Sharinata City Samarinda housing complex with the National Sharia Council Fatwa. This research is a qualitative study with a research approach using case studies. The method used in this qualitative research is the triangulation technique. The object of this research is the Sharinata City Samarinda sharia developer, PT Abi Borneo Mandiri (PT ABM), having its address at Jalan Meranti Talangsari Gang Mufakat No. 1 Samarinda where PT ABM is under the Abi Group, having its address at Jalan Puncak Borobudur No. 435, Malang. The type of data used in this study are primary and secondary data. Researchers obtained research data sourced from in-depth interviews (Indepth Interview), documentation, books and literature related to the istishna 'agreement, as well as reports on records (documents) of the sale and purchase agreement. The data analysis technique used in this study uses descriptive-qualitative analysis. The results of this study indicate that the sale and purchase of Istishna 'in Sharinata City Samarinda Sharia housing meets the requirements stated in the National Sharia Council Fatwa NO: 06 / DSN-MUI / IV / 2000 Concerning Sale and Purchase of Istishna'. But Sharinata City Samarinda sharia property developer has a complete solution related to solving the problem of default (bad credit). First, each individual was given debriefing related to the ethics of debts in Islam by Ustadh Abi Salaam as the chief commissioner of PT Abi Borneo Mandiri (PT ABM). Second, there is a creative solution in the form of sodaqoh, which can be lent to customers if they cannot pay in installments due to udzur syar'i for a maximum of six installments (6 months), while looking for other solutions in the form of business options provided by Abiexpress under the auspices of Abixpress Group, as well as online sales and majapahit coffee (maco), which from the sale of the 60% to pay installments and 40% can be used for other purposes custemer.
