Abstract
Child public road represent problems of prosperity of social in Malang City which seriously need handling from Governmental of Malang City, and also society in general. Pursuant to year data 2006 in Malang City there are about 641 public road children. Reason of family economics still become especial impeller of child work in road. As a result counted 13 % natural public road child break school in is school age. And in general their production is passed to its old fellow. It’s meaning, they are economic asset to their family. From life that's role of old fellow which is obliged to take care of child did not fulfilled. This matter result does not obtain get of rights take care of public road child according to Indonesian Republic Laws Number 23 Year 2002 about Protection of Child. mothering of child as referred to in section 38 sentence ( 2) carried out to through activity of tuition, conservancy, continual education and treatment, and also by giving aid of[is expense of and/or other facility, to guarantee to grow child flower in an optimal fashion, physical goodness, bouncing, social or spiritual, without influencing by child’s religion. Pursuant to Constitution 1945 section 34 mentioned “Impecunious or poor people and child – waif looked after by State”, Malang Government of Malang City hold responsible to. Relate to the mentioned, out for researcher know rights aspect how to take care of to public road child and its execution which conducted by institutes in Malang City according to the Law of Republic Of Indonesia Number 23 year 2002 about Protection of Child. And also to know rights aspect how to take care of public road child according to Islamic laws. This Type Research represents research of conducted field in Malang City with method research of sociologies judicially. Source of law in this research is obtained from source of primary law, and secondary of tertiary. Data collection conducted by observation, interview, and documentation. From result of research can know that in execution of protection of rights take care of public road child in Malang City which conducted by government less optimal, see its minim of existing fund allocation. There are some institute participating in handling of rights take care of public road child, among others; Child Public Road Institute of Griya Baca, Rumah Singgah Flamboyan, Rumah Singgah Putra Harapan Bangsa. Governmental in handling of child of road only have the character of cooperation with institute sides. Besides the institutes cooperate with Islam institute, among others; Rumah Singgah Flamboyan cooperate with Institution Education and Social. While Child Public Road Institute of Griya Baca to cooperate with Malang House Religious obligatory Branch in old fellow program take care of. From 641 covered by public road child is institutes and government only equal to 133 public road child. In executing protection of rights take care of public road child, their activities is in the form of; activity of fundamental covering reach, identify, cultivation of value, federating of child with family, preparation of reference for the enableness of, giving of bursary, skilled training, food addition, recreation and socialization, handling / service of health. Besides activity offundamental also there are activity of supporter like forming of network work to through set of good coordination of governmental government officer, police, LBH, LPA, and society.
