Abstract

Umrah is an Umrah that is carried out outside the season of the Hajj. Under Article 4 PMA No. 8 of 2018 concerning the Implementation of Umrah Worship Travels In the administration of Umrah services not only is the Umrah Worship Travel Bureau (PPIU) the party that can organize Umrah pilgrimage services but the government also has the authority to be able to carry out Umrah pilgrimages. This thesis study aims to determine the shape and role of the government in providing legal protection against Umrah congregations from First Travel who failed to go to Umrah because First Travel defaulted to approximately ± 63,000 Umrah Congregations despite the legal status of Homologation between Umrah Congregation and parties First Travel with the contents of the peace agreement that First Travel promised to depart the Umrah Congregation to carry out Umrah worship and / or refund the Umrah congregation who did not choose to leave. The formulation of the problem proposed is: What are the legal consequences arising from the Homologation between the Debtor (First Travel) and the Concurrent Creditors (Jamaah Umrah); and What form of legal protection should be carried out by the Government to ensure certainty of the fulfillment of the rights of umrah pilgrims First Travel in the First Travel Bankruptcy Case Homologation. This study included normative Juridical research. In this study using an approach by examining and analyzing cases or facts that become problems with legislation related to qualitative descriptive analysis techniques. The final conclusion of this study is that even though there is a Homologation between Umrah Congregation and First Travel Umrah Congregation, they cannot leave to carry out Umrah worship due to restrictions in Law No. 37 of 2004. However, the government as the party that can hold umrah religious services has not provided legal protection to the Umrah congregation that cannot depart even though formally and textually the administration of Umrah has been going quite well.
