Abstract
The object of this study is pornography regulation in Criminal Code and Pornography Draft Bill. Pornography is an issue that has raised for long time, but it does not yet overcome thoroughly. The problems adopted in this study are how is the regulation of pornography according to Criminal Code? How is the regulation of pornography according to Pornography Draft Bill? How is the comparison between pornography regulation according to Criminal Code and Pornography Draft Bill? And how are the required renewal forms of pornography regulation? The purposes of this study are to know the regulation of pornography considered from Criminal Code, to know the regulation of pornography considered from Pornography Draft Bill, to know the comparison between pornography regulation according to Criminal Code and Pornography Draft Bill, and to know the required renewal forms of pornography regulation The research method used in this study is juridical-normative or doctorinal research and comparative juridical methods. Juridical-normative or doctorinal research is a law research that regards law as a norm, typically deal with pornography. Comparative juridical is comparing pornography regulations between law literatures in Criminal Code and Pornography Draft Bill. Through this research, it is obtained that Pornography Draft Bill is more specific, complete, and explicit than Criminal Code in regulating pornography crime, both in the case of action qualification and its witnesses. Thus, it can be concluded that type of pornography crimes regulated in Criminal Code includes adult pornography (article 282) and immature person pornography (article 283). Qualification of pornography crime includes broadcast, display or stick on, create, put into overseas, bring it to overseas or supply writing frankly. While, type of pornography crime regulated in Pornography Draft Bill includes light pornography, serious pornography, and children pornography. Qualification of pornography crime includes creation, multiplication, distribution, using, bearing sponsors' fund, infrastructure, tools, and media in pornography activity (article 4 sub-article (2) letter a, b, c). The valid witness in Pornography Draft Bill is more explicit than in Criminal Code. Suggestion, the formulation of Pornography Draft Bill should regard to the action and criminal aspects, and also its punishment formulation system.
