Abstract

Fulfilling the rights of citizenship in recent years become one of the crucial problems in the lives of Indonesian state administration. Which many citizens that his citizenship is unclear. In this paper we try to present some of the problems of citizenship which focused to emphasize the status of citizenship which the constitution refers to the ever prevailing in Indonesia which provides a reference against any reform of citizenship laws as well as how the fulfillment of citizens constitutional rights. This research is an emphasis on normative legal rules and regulations as well as the basic theory relevant to the title of author. Legal materials used consisted of primary legal materials namely regulations concerned, namely in the form of secondary legal materials written other scholarly writings as well as free as a proponent to provide guidance or clarification from other legal materials. Political aspects of the law on citizenship reform legislation is strongly influenced by the political will of the government in power at that time and the changing format of Indonesian state administration, ranging from pre-1945 constitutional amendment until after the amendment. This also write the effect on regulation changes regarding citizenship, the law number 3 of 1946 until the law number 12 of 2006. Some of these changes also have implications for the enforcement of human rights in the juridical sphere of citizenship, which amendments for these changes to clarify the rights of oppressed minorities through regulation in terms of citizenship rights. Eventually came to the conclusion that the travel experience progression Indonesian citizenship law which is ultimately more moderate and universal in determining the citizenship status and fulfillment of the rights of citizens. This is in line with the conception of the law states that the fulfillment of human rights including the rights of citizenship.
