Abstract

The Rome Statute emerged as a middle ground for the international community. Represented by the mandate of the United Nations to establish a special criminal court that began with the application of the Geneva Treaty, so that the Rome Statute was formed which is the basis of the establishment of the International Criminal Court. More than 100 countries have adapted the Rome Statute to their countries, while Indonesia has not ratified it. Since 2008 talks have begun but until now that is only been a discourse. This is also suspected by the existence of Undang-Undang Nomor 26 Tahun 2000 concerning Human Rights Courts that is not much different from the Rome Statute but has not been able to resolve previous crime cases, even though the 1998 case has been waiting to be resolved and the public continues to demand justice. This study use a normative juridical research method, namely the law approach and the comparative approach. The results obtained that it is urgent that the Rome Statute to be ratified can bring Indonesia to resolve the 1998 case and as a preventative measure so that similar cases do not occur again. In addition, a harmonization of Undang-Undang Nomor 26 Tahun 2000 concerning the Human Rights Court is needed to ratify the Rome Statute, namely in the scope of authority, adopted principles and facilities needed.
