Witness verbalisant is part of an effort to prove the Law of Criminal Procedure, commonly occurs in the practice of justice, but shall not be clearly defined in the statute. Moreover, as already happens in criminal cases on behalf of the defendant's theft H. Hasan Kusairi. Which has been in the proposed witness verbalisant. The problem in this writing are: 1. How is the position of witnesses in an effort verbalisant proof? 2. What is the reason for the prosecutor to produce witnesses in an effort verbalisant proof? 3. How to Judge the basic consideration in examining the witness verbalisant? In this study, the authors use the juridical-sociological approach. The author chose research sites in Kejaksaan Negeri Banyuwangi. Data sources include the author is the primary and secondary data sources. In collecting data, the authors use the method of interview or interviews. As for data analysis, the author uses descriptive qualitative method. From the research, can know the position of witness verbalisant as an effort of proof in its application on the verdict of Judge Number: 104/Pid.B/2008/PN.Bwi. as well as case files which have been prepared by the Public Prosecutor. The authors also present the conclusions and suggestions of writing for the overall results in the application, the presence of witnesses verbalisant can be more objective and can be implemented into the legislation and his position becomes clear in theory and practice.
