Abstract

ABSTRACT Name : St Maryam NIM : 201510020311023 Study Program : Hukum Keluarga Islam Judul : Compilation Review of Islamic Law Against the Legal Status of Withdrawing Uma (House) After Divorce (Case Study in Soki Village, Belo District, Bima Regency). Customs and Traditions prior to the marriage of each Village has its own characteristics and uniqueness. Among Soki Village, Belo District, Bima Regency, which became the location of this research, besides giving dowry, there is a tradition of Wa, a Uma (bring home). Wa, a Uma is a traditional soki village community and has been practiced by most of the community. Wa, a Uma is an obligation that must be brought by the prospective bridegroom to the prospective bride after the agreement and agreement beforehand. Uma is not an item or object that will be mentioned in the Ijab Qabul process like a dowry, but something that must be carried out after the meeting of agreement and existence has been known and carried out by the local community. Withdrawal of Uma (House) after divorce that occurred in Soki Village has been going on since ancient times. Uma Withdrawal is carried out by ex-husband to ex-wife after divorce and has no children, even this withdrawal is done by deliberation. This study aims to determine how the process of withdrawing the Uma and to find out the views of traditional / religious leaders and the local community and in terms of the Compilation of Islamic Law. The method used in this thesis research is sociological empirical or field research with a qualitative approach. Data collection techniques in this research is to use the method of observation, interviews, and search for other supporting data. After all the data collected, the data is analyzed. The results show that if KHI reviews that Uma's withdrawal is a grant or non-refundable grant. This is in accordance with Article 112 of the KHI. However, post-divorce re-examination if viewed under Islamic glasses can be described as' Urf or custom and tradition. so when reviewed from Urf's viewpoint. The tradition of Wa'a Uma and Uma's withdrawal post-divorce in Soki Village are included in 'Urf Sahih because that tradition does not conflict with the principles of Shara' and the existing norms. In addition, the Wa'A Uma tradition and the withdrawal of the post-divorce Uma in Soki Village are included in 'Urf Amali and' Special Urf as they are community-based and only exist in Soki Village.
