Abstract
Bank Muamalat of Indonesia is the first Islamic Bank to be the pioneer of funding development based on the Syariah Principle. One of funding forms commonly done is the Mudharabah (profit sharing) Funding that is one in which the capital owner assigns his/her wealth to the worker to be traded and they make commercial partnership for profit with terms have been mutually agreed in an agreement contract. One of distributions of Mudharabah Funding is aimed to the cooperatives which assessed can improve people’s economy. The Mudharabah Funding to the cooperatives is expected can assist to make people prosperous by means providing a motivation and spirit to be the entrepreneurs among their members. This research took the problem formulations of: 1. What is the implementation of Mudharabah (profit sharing) Credit giving by Bank Muamalat of Indonesia of Malang Branch to the cooperatives whose implementations involved procedures, agreement forms, rights and obligations of parties, and the expiration of agreement? 2. How is the settlement method of contra-performance happened between cooperatives and Bank Muamalat of Indonesia in the mudharabah (profit sharing giving? In this research, the Writer used the juridical-sociological approach; the data collection technique was in form of interviews to the Legal Officer and Marketing of Bank Muamalat of Indonesia of Malang Branch and the Division Head of Koperasi Agroniaga Indonesia (Kanindo) of Dau Branch, Management of BMT Ainul Yaqin and documentation. Afterwards, the data were analyzed as descriptive qualitative. From the results of interviews and documentation showed that the procedures of the mudharabah credit giving in Bank Muamalat of Indonesia of Malang Branch was highly tight accompanied with the analysis with the 5C principle manual, this case related to the conviction acquired and the guaranteed of funding distributed to cooperatives. While the contra-performance settlement method by Bank Muamalat of Indonesia of Malang Branch was more put in the front the settlement by means negotiation in advance namely by rescheduling, reconditioning and restructuring. If by the negotiation way did not met a settlement of problem then the way reached was by the collateral execution. The conclusion that, the procedures within the mudharabah funding more put in the front the sense of mutual trust among the parties, but it is remains that bank makes the deliberate measures in their funding distribution. This case related to the risks existing in a funding. But in the funding settlement Bank Muamalat of Indonesia of Malang Branch always put in the front the approach of the achieved a mutual agreement among the parties. This case is one of the obedience forms of Bank Muamalat of Indonesia of Malang Branch side to the Islamic Syariah (Law). The suggestion, it is needed the more active socialization regarding the mudharabah funding thus it can make the funding based on the syariah (law) principle as the funding considered as most important in the society, this case related to the majority of Indonesia population with the Islamic religion.
