Abstract

This present study discussed about juridical analysis of sociological forms of legal protection for teachers judging from article 39 paragraph (3) law number 14 year 2005 concerning teachers and lectures (case study in the legal area of Sidoarjo). The aim of the study were to discover and review the legal protection for teachers and the resistor factors in implementing the regulations of legal protection for teachers judging from article 39 paragraph (3) law number 14 year 2005 concerning teachers and lectures. This study used sociological juridical method. The type of data used consists of primary data types, and secondary data collection techniques was using interviews, documentation, and observation. Data analysis techniques were carried out qualitatively. The result of the study showed that the forms of legal protection for teachers when they were experiencing unfair actions from students’ parents regulated in legislation has not run optimally. The teacher did not get legal consultation when getting problems with the law, nor was the legal protection action carried out maximally considering that legal protection for teachers was carried out in the form of non-litigation advocacy. With the discrepancy between the laws, the regulations and the existed facts, it creates obstacles in applying legal protection for teachers, these obstacles include forms of legal protection that are not clear in legislation, lack of communication between students’ parents and teachers, no complaints to the government, punishment given by teachers to students, and the students’ morals. Suggestions, it is necessary to form an agreement between the school and parents of students to avoid actions that can hinder legal protection for teachers.
