Abstract

Daya community in inheritance distribution isn’t only give to boys but also girls, the distribution system is not accordance with patrilineal kinship system. The majority inheritance system of male can be replaced by oldest daughter. This study discusses the inheritance distribution implementation, namely the customary inheritance law principles, at the time of inheritance, inheritors and heirs, inheritance, and inheritance process in Daya community. This study uses sociological juridical approach - identification of unwritten laws, primary data obtained from field and secondary data obtained from legislation, court decisions, books, journals, results of previous studies, and websites. Data collection technique is in the form of interviews with respondents of Daya community in South Ogan Komering Ulu regency. Then, the research data is analyzed using descriptive qualitative. Based on the research results in Daya community’s kinship system is patrilineal, and thus it draws the lineage from men. So, father being able to act as inheritors and heirs is seiteha children, the inheritance is handed over before the inheritors dies, this major inheritance system is limited, after the two parents die, the inheritance is shared with male relatives but can give inheritance consideration to girls. In addition, the major male inheritance system that can be replaced by oldest daughter is based on marriage type carried out by the oldest daughter, namely semanda marriage. The conclusion of this study is Daya community inheritance system is limited system of male major inheritance and deliberation in the inheritance distribution is strongly recommended to avoid disputes.
