Abstract

Technological developments lead to changes from all aspects of life in the community. The development is an Ojek Online transportation company in Malang City, namely PT. Grab and PT. Go-Jek Indonesia leaves legal problems in traffic when operating a GPS (Global Positioning System) when driving is an unnatural act and disrupts concentration. Research, formulation of problems How to Implement Article 106 paragraph 1 Jo. Article 283 Law No. 22 of 2009 concerning Road Traffic and Transportation for Go-Jek and Grab-Bike motorists who use GPS when driving in Malang City Police jurisdiction and What are the factors blocking Malang City Police Satlantas in enforcing traffic law regarding GPS usage when driving. using a juridical-sociological approach, primary data sources are obtained from the field and secondary data sources from books, scientific articles, scientific journals, the Internet, the legislation on labor regulations. Data collection techniques, interviews with Malang City Police Headquarters, Grab Drivers and Go-jek Drivers, each of 5 Drivers, Observations, Library Studies as Primary Data. Qualitative descriptive analysis. The results of the study, the police took action by way of hand arrest. The police take action that is seen only so that there is omission if it is not visible. This is the practice of deskretion, the implementation of article 106 is not maximal. Police barriers in taking action have 4 factors: a. Police lack personnel, b. The Traffic Act itself, c. Ojek Online, d. Community needs in the field of transportation. Conclusion, the police have not maximally acted on violations seen from the number of prosecution and the practice of discretion so that more concrete cooperation efforts are needed. Suggestions need to be an effort to renew the Traffic Law and other collaborations that form integrity.
