Abstract

Miranda Rule came to prominence in 1963 in Arizona, the United States of America and subsequently governed in the fifth amendment of the bill of rights. Miranda Rule is a Rule regulating the basic rights of a person or human rights that must be obeyed by the Investigator and all authorized agencies in the judicial process. Therefore, the protection of human rights is very important to be carried out, and will be discussed in this study, with the formulation of the problem: (1) How Implementation of Miranda Rule Principles Against Decision of Merauke PN Sela No. 16 / Pid.B / 2011 / PN .Mrk? (2) Whether the Implementation of the Miranda Rule Principle in the Verdict of Merauke District Court Number 16 / Pid.B / 2011 / PN.Mrk has fulfilled the Element of Justice, Certainty and Utilization of Laws, and Has Guaranteed Human Rights. The purpose of this study is To know and analyze in depth related Implementation of Miranda Rule Principles Against Decision of Merauke District Court Number 16 / Pid.B / 2011 / PN.Mrk. and also To know and review the Implementation of Miranda Rule Principle in the Verdict of Merauke District Court Number 16 / Pid.B / 2011 / PN.Mrk has fulfilled the Justice, Certainty and Utilization Elements of the Law and Has Guaranteed Human Rights. This study uses normative legal research methods. The legal sources used are primary, secondary and tertiary law sources. Technique of collecting data is done by literature study (legal research). The discussion in this research is related to interlocutory decisions that have reflected the principles of miranda rule and have fulfilled the values of justice, certainty and legal benefit, and this study also discusses the human rights that are protected by the presence of the Merauke District Court's decision to grant the excesses of the legal counsel Defendant related to human rights violation and violation of miranda rule principle.
