Abstract
Divorce is the marriage brake off between a wife and husband because they do not feel harmonies in their family. One factor of the reason they choose divorce is mistreatment, a quarrel in a household often with severity to one sided who as subject from quarrel which are done by husband to give vent his anger to his wife. The form of quarrel which always happens is used by litigant to submit divorce’s problem to Religion Jurisdiction of Malang City as physical and psychological. When we observe the procedures which happened in assembly there are many procedures which is noticed are start from investigation step in assembly until result step. The proofs which are used by Judge Committee in divorce’s investigation with the reason of quarrel is letter’s proof and witness’ proof. This research takes the research problems are: 1. How are the mistreatment’s type which is used as the reason to divorce? 2. How the proof’s of mistreatment procedures as the reason to divorce in Religion Jurisdiction of Malang City? In this research, the writer used sociology juridical method with used subject of research Judge Experiment and registrar in Religion Jurisdiction of Malang. Data collection is taken by observation, interview, and documentation of reports, the data analysis which is used is descriptive qualitative analysis. The result, mistreatment in household is was not done every time but once mistreatment which is happened to wife, and wife feel mistreated that the divorce can be realized, it is caused physical factor and the weak background of wife, example wife got one quarrel and she was not accepted about his treatment, and she was not strong enough to do household, she can submit divorce to Religion Jurisdiction.
