Abstract

The main purpose of a worker in doing his job is to get a salary. Salary are workers' rights that are protected by law, both basic wages and overtime wages. In the case of providing overtime pay, companies must think about the feasibility of overtime pay and worker welfare. Calculation of overtime salary has been regulated in Article 8 of the Decree of the Minister of Manpower and Transmigration Number 102 of 2004. This research focuses on the implementation of article 8 and the efforts of companies related to the existence of Article 8. The author uses the Sociological Juridical Approach method. Primary data sources are obtained from the field and secondary data sources are obtained from legislation and data collection techniques in the form of interviews. Then the research data was analyzed qualitatively qualitative. Based on the results of the authors' interviews with 4 interviewees, it was proven that CV Greenline 99 Adv Malang did not apply the calculation of overtime wages in accordance with those stipulated in the ministerial decree. The reason for the company is that this is a small company whose income is insufficient to follow the rules contained in the ministerial decree. The company's efforts to overcome this problem is to provide bonuses outside of basic wages and still provide benefits. The recommendations of the results of this study are expected to provide benefits to the Greenline 99 Adv CV and labor.
