Abstract

Marriage under the hand or marriage of sirri, syar'i marriage and modin marriage is often also called kyai , a number of problems arise as a result of the marriage, not only the legal problems of this unrecorded marriage, but also a social problem arising in the community. Marriage under the hand or marriage of sirri is not recorded causing legal problems that are not small, the impact of the practice under the hands, not only felt by the culprit, but the most felt are children born from the practice of marriage under the hand, when the child is not sinning and not knowing what is going on, but it is the child who later gets the most trouble. Therefore, based on the Decree of the Chairman of the Supreme Court of the Republic of Indonesia on Environmental Affairs of PA No: 01 / SK / TUADA-AG / I / 2013 About the Handling Session Guidelines in Religious Courts, Religious Courts Amuntai Class 1 B conducted a circuit trial in Halong Sub-district Balangan Regency, it is very helpful to the marginalized people who are there. The type of research used is empirical research with sociological juridical approach. The location of the selected research location is at the Amuntai Religious Court Class 1 B and the location of the circuit trial in Halong Sub-district Balangan District on the grounds that the place is conducting the Halong Circuit and Halong District because the distance is very far from the Religious Court which is located approximately 70 kilometers . The types of data used are primary, secondary, and tertiary data. Data collection techniques by interview and documentation related to the topic or title of research. The data that have been collected then in the analysis, the results of field research with existing data, in the analysis to be taken a conclusion. The conclusion is: 1) background why PA Amuntai conducting a circuit trial in Halong District because Itsbat Nikah is very important to do and a very long distance from PA. 2) that the implementation mechanism has been in accordance with the Decree of the Chairperson of the Supreme Court of the Republic of Indonesia Environmental Affairs of PA No: 01 / SK / TUADA-AG / I / 2013 on the Guideline Sessions in the Religious Courts. 3) that there are several supporting and inhibiting factors experienced by the PA and the community during the mobile session.
